You can use a Wisconsin Power of Attorney for Finances and Property to name someone as your Agent to act for you in case you are ever incapacitated or unable to act. The Agent you name would be responsible for managing your finances and property for you according to your instructions while you recover from an injury or illness. This document is also important because it can help you avoid the need for a Court Ordered Guardianship when you grow older in case you are ever incapacitated or mentally unable to manage your own affairs. If you have a Power of Attorney for Finances in place, and a Power of Attorney for Health Care (naming someone to make health care decisions for you) you can choose who should act on your behalf instead of the Court. This also helps avoid an expensive guardianship process for you and your family (Estimated average of $3,000-$5,000 in attorney fees for a Court Ordered Guardianship).
This version includes special Medicaid planning powers which grant authority to your Agent to take certain steps to transfer and or convert your assets to non-countable assets in order to qualify you for Medicaid assistance, should this need ever arise for you in the future. You should only name someone you trust as your Agent and you should only grant these types of powers to your Agent after consultation with an attorney. These Medicaid planning powers can be very useful in last minute planning situations where you are seeking to preserve or protect certain assets in the event you need nursing home care and Medicaid assistance.
