Attorney Thomas B. Burton answer to Question: My son died, who is responsible for his tax bills?

Question:

My son died Friday am i responsible for his tax bills that he may owe? ?

I guess his girlfriend hired an accountant but I just want to know if i will be responsible She is also the mother of his 2 children.

Attorney Response:

Generally, assuming your son is an adult (over 18) and you did not co-sign on any of his bills, the debts of a deceased person are the responsibility of their estate. Your son's debts will be paid by his estate (his assets less any debts owed at death) and if his debts exceed his assets, then the creditors will not be repaid. If your son had a Will, the person he named as Personal Representative is responsible for administering his estate and paying his debts. I am sorry for your loss.
